Correction - that's "2.4 trillion health system" (at least this week, so far...)
The actual cost of malpractice insurance is not the issue. It is the slew of BS tests and documentation just to please some runaway jury and trial lawyer that can escalate cost of care as much as 200% even for simple diagnosis.
Example: Straight forward knee sprain that would be splinted and sent home from ED with instruction to do more tests if not better in 10days- 30$. Due to the MEDMAL headache all people with sprain who limp into an ED will get X-rays,and if there is substantial swelling even MRI and CT scans, orthopedic referral,more tests, repeat imaging!- Cost $2000-10,000--
Ask each specialty of medicine and they will give you hundreds of such examples.
The hidden costs of tests done to discourage lawsuits by over documentation ( "Legal-Medicine Standard of care" ) cannot be trivialized. This has caused the health care costs to rise faster than Bernie Madoff's rate of wealth accumulation in the past 2 decades. .
