Why is it that these large companies get to "to pay a $300,000 fine to the state without admitting wrongdoing? Since Kaiser withheld health care, subsequent health events were perverted by Kaiser's actions. Why NOT go forward with prosecution? The answer, of course, is that Kaiser would be exposed to liability. Gee, if I obtained health care from Kaiser by misrepressenting my coverage status I'd be liable. Thus, if Kaiser withheld care from me in violation of state law, Kaiser ought to be liable as well. COME ON, California Department of Managed Health Care, get Kaiser's filthy hand out of your back pocket. What are they offering you? PAC support for Arnie's next big run for reelection?
The above comment is correct. kaiser should be held liable and the proceedings transparent. Argubably, Kaiser and Wal-Mart are comparable.
