Regarding the penalization of physicians who consistently and knowingly utilize non-contracted labs, how is it fair to have the patients pay for out-of-network costs when it is the contractual obligation of the physician to refer to in-network providers? Not only that, but patients do not have a relationship with labs; they go where the doctor directs them or the lab work is done at the doctor's office and the lab they utilize picks up the specimen to process. Patients don't usually find this out until they get a bill in the mail.
