Steven J. Fox Speaks at 2010 AHIMA Legal EHR Conference

Post & Schell Attorney Partner to Present: “How Strong Contract Negotiation Strategies Can Impact EHR and HITECH Act Success”

WASHINGTON--(BUSINESS WIRE)-- The law firm Post & Schell, P.C. today announced that Attorney Partner Steven J. Fox was invited by the American Health Information Management Association (AHIMA) to present at the 2010 AHIMA Legal EHR Conference.

Held August 16—17, 2010 at the Swissotel Chicago, the conference is addressing key issues in the management of electronic health records (EHRs) in order to support the legal and business needs of healthcare organizations. Fox’s presentation, “How Strong Contract Negotiation Strategies Can Impact EHR and HITECH Act Success,” is taking place on Monday, August 16 at 1:30 p.m.

“A healthcare provider’s approach to contract negotiations with its EHR system vendor directly impacts their ability to successfully leverage the opportunities afforded by the recent health IT stimulus legislation,” says Fox. “Because of the HITECH Act’s aggressive timeframe, providers need to investigate ways to improve chances of qualifying for incentive payments, avoid penalties and costs related to non-compliance, and ensure the vendor’s ongoing performance.”

Fox’s presentation explores such issues as:

  • How providers can use contracts to ensure their chosen EHR vendor (and its EHR system) will comply with certification guidelines;
  • What warranty, indemnity and other provisions can help ensure compliance with and limit an organization’s potential liability related to privacy, security, Stark and other regulations;
  • Given the predicted surge in demand for EHR-related services, how providers can ensure that their vendor remains committed to a thorough and timely implementation; and
  • After implementation, what approaches to contracting providers can use to maintain appropriately high levels of service and quality.
