Tenet wins $46M legal battle

Tenet Healthcare has won a $46 million arbitration settlement in a dispute with one of its business insurance carriers over payments covering damages from a lawsuit. Tenet had sought repayment from three business insurance carriers regarding $395 million the hospital company paid out over allegations that physicians at its Redding (Calif.) Medical Center performed a needless heart procedure. Tenet, which paid out the $395 million in 2004, already received $45 million from one of the three carriers, and its proceeding against the third is still waiting.

Tenet, which sold Redding in 2004, paid $54 million in 2003 to settle civil fraud claims related to an investigation of the facility, plus an additional $6.5 million in 2005. The hospital, which is now owned by Hospital Partners of America, has been renamed as Shasta Regional Medical Center.
