Lawyers in Colorado are reintroducing a bill to the state's legislative session that would incrementally increase the caps on medical malpractice claims, reports the Denver Post. Under current law, plaintiffs who win medical malpractice cases can receive awards of up to $300,000 for non economic damages such as "pain and suffering." In Colorado, all medical malpractice damages, including medical expenses, are capped at $1 million, though judges have discretion to increase the total amount awarded. Under the proposed law, the cap on malpractice awards for non-economic damages would be incrementally raised every year to account for inflation. Article
