A new Florida law will take effect soon that should address a variety of contract and reimbursement issues that have troubled doctors there--and in other states--for quite some time. The new law, effective Nov. 1, will require plans to honor a member's assignment of benefits when they see an in-network physician. It will also ban insurers from selling network discounts to third parties without physician consent (so-called "silent PPOs"), and cut down the amount of time an insurer has to collect alleged overpayments to doctors from 30 months to 12 months. In enacting this law, Florida will become one of 20 states addressing the issue of assignment of benefits. It will also become one of more than a dozen states restricting the use of silent PPOs.
