the key to reform is "indemnification" of physicians who follow best practice guidelines from malpractice claims - a series of best practice guidelines should be approved by the federal government: panel of experts with evidence based or expert opinion data. if the physician follows these guidelines and an "exception" occurs (predictable by statistics) the physician cannot be named in a legal action. these cases should not be settled in court but arbitrated by a panel of physicians who determine whether the guideline has been followed. this would prevent defensive medicine (test ordering) for a major number of conditions (blood in urine, stool, etc.) (headaches and other forms of orthopedic pain) (gyn conditions) (cardiac issues, especially those in patients pre-operatively evaluated with stress tests, echocardiograms, and a host of other tests when they have minimal risk)
It's not just the dr. pay, but also the obscene amt CEOs of ins companies rake in - such as Aetna's 24+million!
Pay enough; limit the litigation risk somewhat and the physicians will follow.....
